TERMS AND CONDITIONS
CLAUSE 1.
General
The following general terms and conditions define the conditions under which Hote Italia provides clients with a service to promote bed and breakfast, hotels, agriturismo and attractive holiday rental accommodation on behalf of their owners through its website.
The client is hereafter defined as the website user.
No other condition will bind Hote Italia without prior written confirmation on its part.
CLAUSE 2.
Accommodations
We do care very much about the quality of our products, and have therefore included only accommodation which we have visited, and which fully lives up to the meaning of the word 'charm'(cleanliness, comfort, quality of surroundings, quality of decoration, hospitality, house of local character). All accommodations presented on the website are private houses. Our selection also takes into account the appropriateness of accommodation (Agriturismo, bed and breakfast etc…) to a given area – excluding that deemed unsuitable.
Although photographs and other pictures are a true representation on the website, they do not have any contractual value, and Hote Italia is not responsible for any changes the owners might have made afterwards.
CLAUSE 3.
Bookings
3.1. Hote Italia centralizes reservations via its website on behalf of the owners of accommodation, so prior to any reservation, the customer must:
-formulate via mail or phone his wishes in terms of accommodation type, services, location, budget, specify the number of people traveling and the dates of stay.
-read the general rental conditions on the page provided for this purpose.
3.2. Once the proposal of hotels and itinerary has been accepted by the customer, an estimate specifying the types of rooms available and hotel prices will be sent. The rates stated in the quote will be valid for 48 hours. Beyond this period, rates may vary due to a dynamic pricing policy applied by most of our partner hotels. As soon as the customer has confirmed his choice of rooms and accepted the quote, Hote Italia will send the customer a booking form by email summarizing the reference of the accommodation, the type of room, the number of people, the price per night, the dates of the stay, the type of payment for the settlement of the deposit, the amount of the deposit to be paid by credit card or bank transfer and the balance to be paid on site. The customer must identify himself by filling in the boxes provided for this purpose and return the completed form for each of the hotels within 24 hours. The rooms will be put on hold for 24 hours after the form is sent. In the case of payment of a deposit by credit card, the customer is required to communicate his credit card number to Hote-Italia at the same time as sending the booking form or within 24 hours of receipt of the form. In the case of a deposit payment by bank transfer, the customer will then have 5 days to send the deposit by bank transfer to the hotel owner. Once the transfer has been made, the customer will be required to send Hote-Italia by e-mail the transfer confirmation issued by their bank. To confirm a booking to our hotels, we send them your first and last name, your address, the number of adults and children, your mobile phone number, your payment information and in specific cases, at the request of certain owners, your email address. The reservation will only be validated and confirmed by Hote-Italia after receipt of the completed booking form, the customer's credit card number or notification of payment of the deposit by bank transfer. Once the reservation has been validated, Hote-Italia will send the customer the documents for their stay by e-mail and a certain amount of information depending on the service chosen for the organization of the trip. A voucher contains the summary of the reservation, the dates of stay, the amount of the balance to be paid on site, the directions to reach the accommodation, the address, the telephone contact and the email of the owner. The rental contract is then considered to be concluded between the client and Hote Italia acting in the name and on behalf of the owner and the mere fact of ticking the boxes appearing on the online booking form "I have read the booking documents and verified the accuracy of the information contained" and "I have read and accepted the general conditions of sale" implies acceptance by the customer of these general rental conditions which he acknowledges having read. The general conditions of sale are accessible from the online booking form and our site. Hote Italia acknowledges having made all the arrangements vis-à-vis the owner so that the accommodation is blocked during the entire reservation procedure and particularly while awaiting payment, but after the deadlines, the reservation will be automatically cancelled.
3.3. Hote Italia reserves the right to refuse any reservation request when it is made by a customer:
- with whom there is a dispute relating to the payment of a previous reservation
- having been the subject of behavior contrary to the normal rules of politeness and good manner
3.4. In general, it is expressly agreed between Hote Italia, the customer and the owner, that electronic mail (email) is authentic between the parties, as is the automatic registration system used by the website.
CLAUSE 4.
Fares and Conditions of payments
The rates are listed in euros for information only on the Hote-Italia website. They will be confirmed to the customer before making any reservation. Unless otherwise stated, prices include VAT and taxes. However, it is possible that some municipalities set up tourist taxes during the year without informing Hote-Italia. Tourist taxes must be paid on site at the hotels. Hote-Italia offers its customers a personalized advice service, tailor-made itinerary with stays in the accommodation of its selection and the organization of their reservations. Service fees ranging from 50 to 200 euros including tax depending on the agency's service and for the entire stay are requested by Hote-Italia. The different formulas will be sent to the customer by email. Payment for the service must be made by bank transfer or credit card. Service fees are due when the customer wishes to receive a detailed proposal.
One the payment is received, Hote Italia will send rapidly a detailed proposal according to the formula chosen by the customer. Payment of the deposit is made by card or bank transfer payable directly to the owner of the accommodation. The balance of the stay must be paid on site, except for villa and apartment rentals. For a postponement of stay without modification of stage and route, only booking fees of a total amount of 35 euros including tax will be applied for the organization of the future stay.
4.1. To confirm your booking, a credit card number will be required. The credit card will be debited of 30% of the full amount by the accommodation.
4.2. Booking a bed and breakfast or hotel confirmed by bank transfer: a deposit of 30% of the full amount will be paid to the accommodation. The bank transfer has to be made not later than 5 days after the online booking form has been filled and sent to Hote Italia. A proof of the bank transfer will be sent to Hote Italia within 5 days to avoid cancellation. The amount due will be paid on site by cash or credit card as indicated in the booking reference.
4.3. Booking rentals and villas of 7 nights or more: a 30 % deposit of the full amount is required to be paid by bank transfer to the owner of the accommodation to confirm the booking. A proof of the bank transfer will be sent to Hote Italia within 5 days to avoid cancellation. The remaining amount of the rental will have to be paid by bank transfer not later than 60 days prior to arrival in the accommodation.
CLAUSE 5.
Cancellation policy
For any cancellation request, the customer is required to contact Hote-Italia and complete a cancellation form which must be requested by email to info@hote-italia.com. The cancellation request will be considered upon receipt of the duly completed form. Cancellation insurance is strongly recommended for all travelers. Any request to modify your stay must be made through Hote Italia.
5.1. If the cancellation takes place for a stay in formula B&B:
- More than 30 days before the start of the stay, no penalty will be applied except the booking fees
-30 days before the check-in date: 30% of the total amount of the stay is due
-29 and 16 days before the check-in date: 70% of the total amount of the stay is due
-15 days and 0 days before the check-in date: 100% of the total amount of the stay is due
5.2. . In the event of cancellation, by the customer, of a stay greater than or equal to 7 nights in self-catering accommodation, the owner of the accommodation will retain 30% of the total amount if the cancellation takes place no later than 30 days before the date of check-in at the accommodation booked, 100% of the total amount if the cancellation takes place less than 30 days before the date of check-in at the accommodation booked.
5.3. In case of no-show of the client, the total amount of the stay is due.
5.4. In the event of delayed arrival and/or premature departure of the customer without having obtained the agreement of the owner of the accommodation or his representative, the customer remains liable for full payment of his stay. Subjective assessments will not be taken into consideration.
5.5. In the event of force majeure (epidemic, natural disasters, etc.), a postponement of the stay may be considered. A request for a refund can be evaluated in agreement with our partner hotels.
5.6. Apart from cases of force majeure, it is possible in certain cases to consider postponing your stay. Proof specifying the reasons related to the impossibility for the customer to travel must be provided. The possibility of rescheduling the stay will be assessed by Hote-Italia and the accommodation booked, depending on the season in which the stay was booked, the reason for cancellation and the date on which the stay was cancelled. This postponement may take place within one year from the date of said cancellation or the initial stay. The postponement date will be set jointly by the customer and Hote-Italia, depending on the availability and prices of the reserved accommodation as well as the customer's wishes. We always try and as far as possible to find a suitable solution for our customers, our agency and our partners.
CLAUSE 6.
Arrival and departure
Arrival times, except special notification, are from 8 am to 9 pm and the client will keep the owner informed of any delay. Without any news from the Client for 24 hours after the scheduled time of arrival, the owner is entitled to put the accommodation back up for rent without any penalty whatsoever.
Upon arrival, the client has to show the owner the booking confirmation voucher and to possibly pay in cash a safety deposit the amount of which will have been stipulated before. It will be given back to the client at the end of the stay after the cost of any possible damage has been deducted.
CLAUSE 7.
Customer satisfaction surveys
We use our own customers satisfaction surveys in order to evaluate and follow the quality standards and the services provided by the hotels. A yearly report is sent to each hotel so that the owners can improve the quality of their hotel and the services provided. Each survey is analysed by our moderator prior to its publication on our website. Any defamatory or inappropriate comment will not be published.
CLAUSE 8.
Complaints
All claims must be made to the owner on the site. If a dispute arises, Hote Italia will help to find a solution between the client and the owner. However, Hote Italia will only act as a conciliator in trying to solve the dispute and will therefore not be under any obligation to guarantee a solution.
CLAUSE 9.
Data protection and Privacy
In accordance to the French law « Informatique et Libertés » of 6 January 1978 modified by the law of 6 August 2004, relating to the setting up of files or processing of data of a personal nature, the users are informed they have the right to access their own information and to modify it. This right can be exercised upon a simple written request by post or e-mail. The personal data gathered are only used by the website and are not transmitted to any third party. The gathered data can be used, with the agreement of the user, to inform him about new services, special or commercial offers about Hote Italia or its partners.
CLAUSE 10.
Confidentiality agreement
In accordance to the GRPD law of May 25, 2018, you can contact us at any time to ask a copy of your personal data held by us, inform us about any change occurred to your personal data or update your details. You may have the right to request the erasure or the restriction of the processing of your data. To exercise any of these rights, please contact us at: partners@hote-italia.com.
10a. Information on the processing of personal data
Personal information required on our online forms, such as name, surname, telephone number and payment method, are essential to confirm a booking/reservation. We need to collect these information to be able to process and finalize a booking/reservation. When we confirm a booking/reservation to a hotel, we share the following information with our partner (hotel): your name and surname, number of adults and children, your mobile number, your payment information and in some cases, upon request from the hotels, your email address. The hotels booked through our agency may contact you by telephone, and in some cases by email, to have some information about your arrival time and to give you more information on the access to the hotel. We need your personal information to manage your booking(s) and make sure that you receive the best service. We also use your personal information to contact you about your booking and occasionally, only if you have subscribed to our newsletter, to inform you about special offers, new products or services that, we assume, can be of interest to you.
10b. Protection and storage of your personal data
To ensure the protection and confidentiality of your data, we use suitable systems and procedures. We apply security procedures along with physical and technical restrictions to access/use of your personal data stored on our servers. Only authorised Hote Italia personnel is allowed to access to your personal data. We will store your personal data for as long as necessary for you to use our services, to comply with the law(s) in force and solve disputes with any party and to allow us to exercise our activity, including the prevention and detection of frauds and other illegal activities. All personal information stored are submitted to our "Confidentiality agreement". If you have any questions related to the storage of your personal data or if you want us to delete permanently your personal information from our database, please contact us at: partners@hote-italia.com.
10c. Your rights related to the processing of your personal data
You can contact us at any time to ask a copy of your personal data, inform us about any change occurred to your personal data or update your personal details. In some cases, you can send us a request to delete, erase or restrict the processing and use of your personal data. In other cases, you can object to the processing of your personal data. You can also authorise us to share your personal data with third parties. If you have granted us the permission to share your personal data with third parties, you have the right, at any time and in compliance with the law, to revoke the above-mentioned permission. Please ensure that your personal information are up to date, to do so you can contact us by mail or telephone to communicate any changes. All questions regarding the present "Confidentiality agreement" and the exercise of your rights should be addressed to our Manager for the protection of personal data by email to this address: partners@hote-italia.com. You can also contact your local Authority for the protection of personal data. If you wish to object to the processing of your personal data, for the sake of your legitimate interest, and no meaning to unsubscribe is directly available on our website, please contact us at: partners@hote-italia.com.
10d. Customers' reviews
Upon return from a stay booked through our agency, you may be asked to fill in a satisfaction survey. You will be able to choose whether to publish your comments anonymously or to indicate your first name and city. When you write a review, you accept that it may be published on our Customers' reviews page. Our aim is to inform other travellers about the quality of the accommodation that you have visited and the quality of the services provided by Hote Italia to organise your stay. You can contact us at any time to request the removal of your review from our Customers' reviews page.
10e. Cookies policy
Cookies allow you to be identified as a unique user when you navigate through several pages of a website. The following information are collected through the cookies: IP address, computer ID, pages visited, type of browser, navigation information, Operating System, internet provider, timestamping, referring URL if you land on our pages through a web advertisement, functionalities used and activities realised on the website/Applications.
We authorise third parties to place technical cookies on our website for the sole purpose of checking the correct efficiency and ensure the visibility on internet of said website.
We authorise third parties to place analytical cookies on our website for the purpose of analysing how visitors navigate through our website, detect malfunctioning and optimise it. We use analytical cookies for Online Advertising Campaigns on Google search network only to evaluate the impact of said campaigns. Data collected through advertising campaigns help us to evaluate and monitor the pertinency of our web ads. We do not use advertising cookies on our pages and we do not authorise third parties to place any.
CLAUSE 11.
Applicable law-disputes
These general conditions are subject to French law.
